These Terms of Use (“Terms”) govern your use of the LastItem iPhone application and lastitem.app, provided by MN Booth LLC (“we,” “us,” or “our”). By using LastItem, you agree to these Terms and Apple’s applicable App Store terms.
1. Purpose
LastItem is a personal productivity tool for creating reusable lists and manually checking items before departure or return. It is not an inventory certification, tracking, recovery, insurance, emergency, or safety system.
2. Your responsibility
You are responsible for the accuracy of your kits and for physically checking, securing, transporting, and protecting your property. A completed check reflects your input only. LastItem cannot sense, locate, secure, insure, or prove possession of a physical item, and it does not guarantee that property will not be lost, damaged, or left behind.
3. License and acceptable use
Subject to these Terms and Apple’s rules, MN Booth LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use LastItem on devices associated with your Apple Account. You may not misuse the app or website, interfere with their operation, defeat technical protections, distribute unauthorized copies, or use them unlawfully.
4. Your data and backups
You are responsible for your device, Apple backup choices, and exports you create or share. The app is local-first and does not provide an MN Booth LLC cloud backup or recovery service. Deleting the app or local data may be irreversible. Review the Privacy Policy for data-handling details.
5. Purchases
LastItem Pro is intended as a non-consumable in-app purchase processed by Apple. Availability, localized price, tax, payment, refund, Family Sharing eligibility, and transaction history are governed by Apple and the App Store terms applicable to your storefront. Pro access requires a verified Apple transaction and may be reconciled through StoreKit.
6. Availability and changes
We may improve, update, suspend, or discontinue features subject to applicable law and Apple’s platform rules. The website may describe planned availability only when clearly labeled; it does not create a promise that an unfinished feature will ship.
7. Disclaimer
To the maximum extent permitted by law, LastItem and the website are provided “as is” and “as available,” without warranties of uninterrupted operation, error-free results, fitness for a particular purpose, non-infringement, or guaranteed loss prevention. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
8. Limitation of liability
To the maximum extent permitted by law, MN Booth LLC and its members, personnel, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of property, data, revenue, business, or opportunity arising from your use of or inability to use LastItem. Nothing in these Terms limits liability that cannot legally be limited.
9. Termination
You may stop using LastItem at any time. We may suspend access to website services or terminate a license where permitted if you materially violate these Terms. Provisions that by their nature should survive will survive termination.
10. Governing terms
These Terms are governed by applicable United States law and the law of the state where MN Booth LLC is organized, without regard to conflict-of-law rules, except where consumer law requires otherwise. Apple is not responsible for maintenance or support obligations beyond its platform responsibilities.
11. Changes
We may update these Terms. The effective date identifies the current version. Continued use after an update constitutes acceptance where permitted by law.
